The engagement letter entered into with Brouwer Legal is governed by its general terms and conditions, which can be found on the website and will be sent to you free of charge at your request.
All agreements between Brouwer Legal and its client, and all other legal relationships between Brouwer Legal and its client relating to those agreements, are governed by Dutch law.
Brouwer Legal carries out the engagement entered into with it with due care, attention and expertise. In the unlikely event that Brouwer Legal is in breach of this obligation, or any other obligation, any and all liability is limited to the amount paid in the case in question under the professional liability insurance taken out by Brouwer Legal, increased by the excess that applies under the policy.
1. Brouwer Legal’s lawyers are insured against liability for damage with Markel International Nederland, having its registered office and maintaining a place of business at Westplein 1214, (NL-3016 BM) Rotterdam, the Netherlands.
2. Rechtsanwälte N.J.H. Leferink, B. Honerbom and M. Plaß are furthermore insured against liability for damage with AXA Versicherung, having its registered office and maintaining a place of business at Wiener Platz 3, (D-51065) Köln, Germany.
3. Rechtswalt J. Haukes is furthermore insured against liability for damage with HDI Versicherung AG, having its registered office and maintaining a place of business at Heilbronner Straße 158, (D-70191) Stuttgart.
  If damage is inflicted on persons or goods for which Brouwer Legal is liable through or in connection with the completion of an engagement entered into with a client or otherwise, that liability is limited to the amount(s) covered under the general liability insurance taken out by Brouwer Legal, including the excess payable by Brouwer Legal in respect of that insurance. If for any reason none of those insurance policies covers any amount, any and all liability is limited to the amount that Brouwer Legal has charged in fees in the case concerned and that has been paid by the client, subject to a maximum of €25,000.
Brouwer Legal has an internal complaints procedure. All disputes arising from the formation or provision of our services, including any disputes concerning invoices, must be submitted in writing (by post, fax or e-mail: honerbom@brouwerlegal.com) to our internal complaints officer.
Brouwer Legal’s hourly rates vary and depend on the number of years of experience of the lawyer in question. The exact hourly rate is set out in the engagement letter. Our costs are based on that hourly rate multiplied by the number of hours (or parts of hours) spent on the engagement, to be calculated in fixed time units of six minutes. The hourly rate is adjusted each year on 1 January (indexation). In addition, changes in the importance of the case, urgency, years of experience and specialist areas may lead to (possibly temporary) changes to the agreed rate. You will be informed of such rate changes in good time. Travel time will be charged at an hourly rate of half the hourly rate that applies at that time. Kilometre costs will not be charged to you separately. Additional costs, such as bailiff fees, court registry fees and costs involved in requesting (for instance) extracts will be charged to you separately. Our work (including travel time) is usually invoiced once a month. Additional costs may be charged to you in the interim. Payment must be made within 14 days of the invoice date.
Brouwer Legal is a law firm that provides legal services (both litigation and consultancy) in the field of corporate law and related employment law. When entering into the agreement, the nature and, if possible, the scope of the work will be described (on a case-by-case basis) both orally and in writing.
